1. Acceptance of Terms

Welcome to SyncBooster ("we", "our", "Company"). These Terms of Service ("Terms") govern your use of our social media management platform and related services (collectively, the "Service").

By accessing or using SyncBooster, you accept these Terms. If you do not agree with any part of them, you may not use the Service.

1.1 Agreement Formation

• Access and use of the Service constitutes acceptance of the Terms
• Terms apply to all users: unregistered, registered, and premium
• To use the Service, you must be at least 13 years old
• Persons under 18 require parental/guardian consent

1.2 Changes to Terms

• We reserve the right to change the Terms at any time
• Significant changes will be announced via email or in the application
• Continued use constitutes acceptance of new Terms
• We recommend periodic review of the Terms

2. Service Description

SyncBooster is an AI-powered social media marketing automation platform that enables intelligent content creation, personalization, and publishing across multiple platforms using artificial intelligence.

2.1 Key Features

• AI Assistant: Intelligent post creation based on photos and short descriptions
• Personalization: AI learns your company's communication style
• Social Media Management: Connecting and managing multiple accounts (Facebook, Instagram, LinkedIn, Google Business Profile)
• Graphic Generation (all plans): Dedicated panel for AI graphic generation in SyncBooster Studio
• Post Editing: Manual editing of generated posts and natural-language changes in chat
• Intelligent Image Analysis: AI automatically recognizes uploaded photo content
• Content Scheduling: Publishing schedule at optimal times
• Token System: Pay only for AI features you use

2.2 AI Technology (EU AI Act 2024/2025 Compliance)

• AI Models: We use third-party providers' models (incl. OpenAI, Anthropic, Google) listed in the Privacy Policy; the model used may change
• Data Analysis: AI analyzes onboarding interview data and company website
• Style Learning: AI adapts to your unique brand voice
• User Control: Every post requires approval before publishing
• No Automated Decisions: AI does not make decisions affecting user rights
• Transparency: Clear information about AI-generated content

2.3 Platform Integrations

• Facebook: Publishing posts on business pages (active)
• Instagram: Publishing posts on business accounts (active)
• LinkedIn: Publishing on personal profiles and company pages (active)
• Google Business Profile: Business listing management (active)
• X (Twitter), TikTok, YouTube: Integrations in preparation (coming soon)

3. User Accounts and Registration

3.1 Account Creation

• Provide true, complete, and current registration data
• You are responsible for the confidentiality of login data
• Immediately report unauthorized access
• One person/entity may have one account, unless otherwise agreed

3.2 Account Security

• Password: Set a strong password and protect it
• 2FA: We recommend enabling additional security measures
• Monitoring: Monitor your account for abuse
• Incidents: Report suspected breaches immediately

3.3 Login Methods

• Email/Password: Traditional registration with email verification
• Google OAuth: Single sign-on through Google account
• Email Verification: Required for all accounts
• Sessions: Secure management and automatic expiration

3.4 User Age

• Minimum Age: 18 years (for paid subscription)
• 16-18 years: Parental/guardian consent required (for trial period)
• Verification: We verify age during registration
• Responsibility: Parents are responsible for minors' actions

4. Acceptable Use Policy

4.1 Permitted Activities

• Using the Service for legal social media management purposes
• Creating and publishing content compliant with platform rules
• Connecting only your own accounts for which you have permissions
• Collaborating with teams within approved accounts

4.2 Prohibited Activities

You agree NOT to use the Service for:

4.2.1 Illegal Activities

• Violating laws, regulations, or third-party rights
• Fraud, deceptive practices, or manipulation
• Infringement of intellectual property rights
• Money laundering, terrorism financing, or other crimes

4.2.2 Harmful Content

• Publishing defamatory, harassing, or threatening content
• Sharing content promoting violence, hatred, or discrimination
• Distributing spam, unsolicited communications, or malicious software
• Transmitting content containing viruses, malware, or harmful code

4.2.3 Platform Abuse

• Attempting to gain unauthorized access to other users' accounts
• Reverse engineering, decompilation, or attempts to obtain source code
• Using automated tools without consent
• Disrupting or interfering with Service operation

5. Social Media Platform Integrations

5.1 OAuth 2.0 Authorization

• Facebook, Instagram: OAuth through Meta Platforms Ireland Ltd
• Google Business Profile: OAuth through Google LLC (active)
• LinkedIn: OAuth through LinkedIn (active - personal profiles)
• X (Twitter), TikTok, YouTube: OAuth (coming soon)
• Permission Scope:
  • Publishing posts on behalf of user
  • Reading basic profile data (name, follower count)
  • NOT: Reading private messages, changing passwords
• You can revoke access in account settings at any time

5.2 Platform Terms Compliance

• Meta Platform Policy (FB/IG): User obligated to comply
• Google Terms of Service: API policy compliance
• LinkedIn User Agreement: Rules for business accounts
• X/Twitter Terms of Service: Content publishing rules
• SyncBooster NOT responsible for user violations of platform terms
• Account blocking possibility by platform - outside SyncBooster control

5.3 Account Disconnection

• Disconnection possible at any time in settings
• OAuth tokens removed immediately
• API data stored for up to 30 days (cache)
• Post publishing suspended after disconnection

6. Intellectual Property

6.1 User Content Ownership

• Full Copyright: User retains ownership of:
  • AI-generated posts
  • Uploaded photos/files
  • All content modifications
• Consent under the agreement: User consents to the processing of submitted content to the extent necessary to perform the electronic services agreement:
  • Publication on social media platforms
  • Backups
  • Cache and optimization
• Consent applies for the duration of the service and expires upon content deletion or account closure

6.2 AI-Generated Content (EU AI Act 2024 Compliance)

• User = owner of AI post IP
• No SyncBooster claims to AI-generated content
• AI acts as a tool, not as content creator
• User bears full responsibility for AI content

6.3 Data Use for AI Development

• Optional consent (checkbox): for:
  • Anonymized data for AI training
  • Research and technology development
  • No user identification possible
• Right to withdraw consent at any time
• GDPR compliance (data minimization)

6.4 Content Responsibility

• You are responsible for the legality and appropriateness of your content
• You represent that content does not violate third-party rights
• You agree to indemnify us from claims arising from your content
• We may remove content that violates Terms or law

7. Subscription Model and Payments

7.1 Subscription Plans and Pricing

Token System (Costs):

• 1 text post (with own graphic): 20 tokens
• AI graphic generation in SyncBooster Studio (all plans): 35 tokens (generation and regeneration)
• Text correction requests: 20 tokens
• Onboarding agent correspondence: Unlimited (free, max 150 messages/month)
• Publishing generated post: Free
• 100 tokens on start + 100 for marketing consent (up to 200 total): Free
• Token validity: 31 days from purchase

7.2 Payment Methods

• T-Pay: Main payment method
• Credit Cards: Visa, Mastercard, American Express
• Currency: PLN (with EUR/USD option for international clients)
• VAT Invoice: Sent automatically to email after payment
• Security: All payments encrypted SSL/TLS

7.3 Refunds and Cancellations

• Subscription Cancellation: At any time in account settings
• Access until period end: Service continues until end of current billing period
• No refund for unused tokens: Clear information before purchase
• Disputes: Direct payment inquiries to [email protected]

7.4 Right of Withdrawal (B2C Consumers)

• Standard 14 days to withdraw from the contract
• EXCEPTION: Loss of right after:
  • Consent to start service provision (checkbox during purchase)
  • Starting to use the service (using tokens)
• Checkbox during purchase:

  ☑️ "I consent to immediate start of digital service provision before the 14-day withdrawal period expires. I understand that after using tokens I lose the right of withdrawal according to Art. 38 pt 13 of the Polish Consumer Rights Act."

• Refund: Within 14 days (only if tokens not used)
• B2B (agencies): Different terms - no 14-day right of withdrawal

8. Service Availability and Performance

8.1 Service Level

• Target uptime: 99% (excluding maintenance)
• Support response time: 24h (Business), 48h (Start), 2h (Agency)
• We monitor performance and respond quickly to issues
• We provide status updates during service interruptions

8.2 Maintenance and Updates

• Scheduled Maintenance: Announced in advance
• Emergency Maintenance: May occur without notice
• Updates: We regularly update and improve the Service
• Feature Changes: We add new and modify existing features

8.3 Quality Monitoring and Debugging

• Data processed (legitimate interest):
  • Usage logs (IP, browser, session time, actions performed)
  • Technical data (system errors, API logs, response time)
  • Input data content only in case of error report
• Purpose: Error detection, performance monitoring, security
• Retention period: 12 months (logs), 30 days (cache)
• Right to object: You can object at [email protected]

9. Liability and Warranties

9.1 Liability Exclusions (DSA and Civil Code Compliant)

SYNCBOOSTER IS NOT LIABLE FOR:

• Third-party platform errors: FB, IG, Google API
• Account blocking: By social media platform
• Data loss: Due to force majeure
• User actions: Non-compliant with platform terms
• AI content: User = responsible for AI-generated content

9.2 Liability Limitation

• Maximum liability: 100% of subscription value from last 12 months
• Free plan: Maximum 100 PLN
• Not including: Indirect damages, lost profits, reputation
• Limitations: Apply regardless of legal basis of claim

9.3 Quality Warranties

• Target uptime: 99% (excluding maintenance)
• Support response time: According to subscription plan
• No warranty: AI accuracy, marketing results
• Service: Provided "as is"

10. Agreement Termination

10.1 Termination by User

• You may terminate the agreement (delete account) in account settings
• Effect is immediate upon completion of the process
• You are responsible for fees accrued before termination
• Some Terms provisions remain in effect

10.2 Termination by Us

We may immediately suspend or terminate access without notice in case of:

• Violation of Terms or our policies
• Violation of legal regulations
• Fraudulent, abusive, or harmful activities
• Extended account inactivity

10.3 Effects of Termination

Upon agreement termination:

• Access to the Service is immediately terminated
• Your content may be deleted (subject to backup retention)
• You will lose access to the dashboard and data
• Unused portion of subscription is generally non-refundable

11. Dispute Resolution

11.1 Amicable Procedure

• Before initiating proceedings, you agree to contact us for amicable resolution
• We act in good faith to resolve disputes amicably
• You should provide a description of the dispute and expected resolution
• We respond to dispute reports within 30 days

11.2 Governing Law

• Terms are subject to Polish law
• You consent to the jurisdiction of Polish courts
• We strive for fair dispute resolution in accordance with law

11.3 Consumer Rights (UOKiK)

• Consultations: Free legal advice for consumers

12. International Use

The Service is available globally, subject to local regulations and restrictions. Some features may not be available in every jurisdiction. Users are responsible for compliance with local law, and we comply with applicable international trade and export regulations.

13. Final Provisions

13.1 Entire Agreement

These Terms together with the Privacy Policy constitute the entire agreement between you and SyncBooster and supersede all prior agreements.

13.2 Changes

We may modify the Terms by publishing an updated version. We will notify you of significant changes via email or in the platform. Continued use constitutes acceptance of changes.

13.3 Severability

If any provision proves unenforceable, it will be appropriately modified while preserving its purpose. The remaining provisions remain in effect.

13.4 Digital Services Act (2025)

• Content moderation transparency: Notification of removal of illegal content
• Appeal possibility: From decisions (email: [email protected])
• AI algorithm information: Description in section 2.2
• No profiling: For advertising purposes
• Authority contact: [email protected]

13.5 EU AI Act (2024/2025)

• Classification: Limited risk generative AI
• Obligations:
  • Informing about AI-generated content
  • Transparency about logic operation
  • No bias and discrimination (monitoring)
• User right: To explanation of AI decisions
